Terms of Service

Dear user (hereinafter referred to as "user", "you"), welcome to FreeShort! Before you log in, access or use the FreeShort products and services (hereinafter referred to as "Service", "FreeShort") provided by this platform and its affiliates (hereinafter referred to as "we", "our"), please read the User Service Terms (hereinafter referred to as "Terms") carefully, especially those parts that may limit our liability or involve your major rights. If you do not agree to our terms, you may not use the Service. Your use and/or continued use of the Service constitutes your acceptance of all terms of the Service.

You confirm to us that you are an adult and have full legal capacity. If you are a minor or lack full legal capacity, you will not be allowed to register, log in or use the Service. These Terms include the following terms and conditions, the agreements expressly included in these Terms, and all rules that we may publish in the future. All these rules are deemed an integral part of these Terms and have the same legal effect. Unless otherwise expressly stated, your use of the Service constitutes your agreement to be bound by these Terms and constitutes a legally binding contract between you and us.

We reserve the right to modify and/or revise these Terms periodically by issuing notices and/or other reasonable means. We encourage you to review the revised Terms regularly, and you must comply with them when using the Services. Your continued use of our Services constitutes your acceptance of the revised Terms. Any dispute between you and FreeShort will be subject to the latest Terms. If you do not agree to the revised Terms, you must stop using the Services.

Account

To use the Services, you must create an account approved by us and log in. If you access the Services through a third-party account approved by us, you must ensure the reliability, authenticity and availability of the account. If you are unable to log in to FreeShort due to a third-party account problem (such as an account being suspended), please contact the company to which the account belongs. Your account will be our only reference to verify your identity.

You should bind your account with your mobile phone number (one mobile phone number can only register one account). Please register an account with a mobile phone number that has not been bound to your FreeShort account and has not been suspended by us. The account registration and binding method may change according to user or product needs, and you agree to comply with changes in accordance with local laws and regulations. You agree that we will use the mobile phone number you provide and/or the mobile phone number and mobile device identification code that we automatically extract when you register.

Since FreeShort is a location-based mobile entertainment product, you can decide whether to authorize us to disclose and use your location information when registering. If you grant us such permissions, we will provide you with more personalized services based on your location. If you do not grant us such permissions, you can still use the basic functions and services we provide, but it may affect the related services based on location information.

When you register, log in or use FreeShort, we need to collect personal information that can identify you so that we can contact you when necessary or provide you with a better user experience. You agree to provide true, detailed and accurate personal information ("Personal Information") with consent. Personal Information may include but is not limited to user name, gender, age, date of birth, ID card, address, occupation and industry, height, weight, income, interests, personal information and other information you register/update. You agree to update any changes in your personal information in a timely manner. If the personal information you provide is inaccurate, false or contains illegal/offensive information, we may reject your registration application and terminate your use of the service.

You agree not to:

(1) register your own FreeShort account using any false information;

(2) register your own FreeShort account in the name of another person without relevant permission;

(3) excessively register your FreeShort account;

(4) register and maintain more than one FreeShort account at the same time.

If you use false information to impersonate an already registered account, or your account avatar, personal information and other information contain illegal/harmful content, we have the right to take measures such as notifying you to correct it, suspending the use of your account for a limited period of time; for accounts registered in the name of others or with malicious intent, we have the right to cancel them and report to the relevant government authorities.

You confirm that you have full civil and legal capacity to agree to these Terms of Service in accordance with the laws and policies of various countries, and can independently assume responsibility for your use of the services we provide. If you do not have the above civil and legal capacity, it is recommended that you read these Terms of Service in the presence of your guardian. 

You may not use this service unless your guardian agrees to your use of this service and these Terms of Service. If you are required to bear liability under applicable law or these Terms of Service, we will revoke the right to seek compensation from your guardian. The user name, nickname, icon and other account information you fill in, log in or use during the use of this service shall not violate the provisions of laws and regulations, national systems, national interests, citizens' legitimate rights and interests, public order or social morality, and always provide true information. It is prohibited to provide any illegal or harmful information. 

You further guarantee that the account information you fill in, log in or use shall not contain the following content: violate the provisions of the Constitution and other laws and regulations; endanger national security, state secrets, state power and/or national unity; damage national honor, interests or social public interests; incite ethnic hatred, ethnic discrimination, and undermine national unity; violate national religious policies and promote cults and superstitions; spread rumors and disrupt social order or stability; spread obscenity, gambling, violence, murder, terror or abet crimes; insult or slander others or damage others' legitimate rights and interests; other content prohibited by laws and regulations. If the account icon, nickname and other account information you log in or use contains illegal or harmful information, we have the right to notify you to correct it within a time limit, suspend the use of your account or take other measures against you. 

If you log in, use or fill in your user name, nickname, icon as any entity or celebrity, we have the right to deactivate the account and report it to the relevant government authorities. You must keep your account and password safe, otherwise you will be fully responsible for any damage caused to you, us or any third party. You agree to take full responsibility for all activities and events that occur under your account. 

You can change the password of your account at any time. You agree to notify us immediately if you know or suspect that your account has been used illegally or there is an error.

For some features or individual services of FreeShort, such as posting content, posting comments and/or searching, you may need to provide additional information in addition to creating an account, for example, you may need to display your location or provide real-name authentication.

Service Guide

FreeShort is a location-based social platform where you can upload, browse, share, search and comment on videos. We would like to remind you that you are responsible for the legality, accuracy, completeness, authenticity or quality of your registration information and any messages, files, text, software, music, audio, photos, pictures, videos or information you upload, post or store, transmit or publish in any way through FreeShort.

You agree not to abuse the service. You guarantee that you will use the service in accordance with the laws, regulations and these terms and will not engage in any harmful, illegal or infringing behavior, otherwise, you will bear all consequences. In addition, you shall be fully responsible for any losses caused to us or any third party due to the above violations.

You agree to comply with the applicable laws, regulations and local moral and cultural customs in your jurisdiction when using this service, otherwise you will bear full responsibility for it. In addition, please use this service appropriately and responsibly. If your behavior causes us to violate laws and regulations or involve political or public events, we have the right to suspend or terminate this service.

In any case, you agree not to:

Use the Service for any illegal activities;

Use the Service for any activities that are harmful or potentially harmful to minors;

Send junk emails, spam from your account, or help others send junk emails, spam;

Display any inappropriate text, audio or video (such as pornography, violence, vulgarity, terror, barbarity and other content that violates laws and regulations, social morality or national cultural traditions/customs);

Engage in any false or misleading activities (such as trying to ask for money by fabricating false reasons or impersonating others);

Perform any behavior that is detrimental to the Service or others (such as posting or spreading viruses, stalking, discrimination, posting hate speech/abusive comments, advocating violence against others or animal abuse);

Infringe on the rights of others (such as uploading, storing or posting manuscripts, music, photos or videos that are unauthorized third-party intellectual property); Infringe on the privacy of others (such as secretly photographing others);

Use the Service in any way that may interfere with, damage, affect or restrict other users from using the Service properly, or in any way Use the Services in a manner that could damage, disable, overburden the Services, or interfere with the proper working of the Services;

Send any unsolicited or unauthorized advertising, solicitations, promotional materials, junk mail, chain letters, or pyramid schemes, or conceal or misrepresent the identity of the sender in order to send junk mail, spam, or commercial email;

Harvest or collect email addresses, phone numbers, instant messaging numbers, and other information from other users without their consent;

Use any robot, spider, crawler, scraper, or other automated means to access our Services or collect data;

Reverse engineer or obtain source code for the Services in any way, or circumvent or bypass measures implemented to prevent or restrict access to any areas, content, or code on the Services; Use or attempt to use any unauthorized account; Impersonate or post information on behalf of any other person or entity, or misrepresent your affiliation with any other person or entity; Attempt to circumvent any content filtering technology we may use, or attempt to access any Services or areas that you are not authorized to access; Post any advertisement that recommends products or services other than FreeShort and its affiliates. You also agree not to solicit our users to use similar competing products or platform services for any reason or in any manner; engage in any activities that violate any laws, regulations, policies or rules of FreeShort or are harmful to us and/or other users. You acknowledge and agree that you will not use the Services for sales or any other commercial purpose without our express consent. 

If you wish to use the Services for commercial purposes, please provide us with written notice and obtain official authorization. You agree to be responsible for your actions during the use of the Services, including but not limited to directly compensating the infringing party for losses. If your actions cause us to bear administrative penalties or infringement compensation, you shall fully compensate us for our losses. For any violation of the above provisions, we may, at our sole discretion, immediately suspend or terminate your access to part or all of the Services, including freezing or canceling your access to your account and/or deleting your user content. 

You understand and agree that we may provide the necessary information submitted by you during the use of the Services or stored on FreeShort's servers to the competent authorities at their request. After our preliminary evaluation, if you are suspected of infringing the legitimate rights and interests of others, we may provide the above necessary information to the relevant rights holders. You understand that this service only provides a platform for video sharing. Any other equipment related to the Service (such as personal computers, mobile phones and devices connected to the Internet or the network) and their costs (such as telephone charges, Internet connection fees or mobile network fees) are at your expense. 

You acknowledge that we may publish commercial advertisements and other commercial information in various ways in the course of providing the Service. You agree that we may provide you with such information by sending emails, private messages or other means. Unless otherwise expressly provided in these Terms, all new products, new features and services launched by FreeShort are subject to these Terms.

Data

Unless otherwise proven, the data stored on FreeShort's servers will be deemed as the only evidence to verify your use of the Service.

Ownership and Exercise of Rights

All intellectual property rights, including but not limited to copyrights, trademarks, patents, trade secrets and any other proprietary rights related to FreeShort, belong to us or our licensors. Except as expressly provided in these Terms, we do not grant you any intellectual property licenses or other rights. You agree not to infringe our or our licensors' intellectual property rights. Any unauthorized use of our intellectual property is a violation of these Terms and may also violate applicable laws, including but not limited to copyright and trademark laws and applicable communications regulations and statutes.

The ownership and intellectual property rights (including but not limited to copyright, trademarks and patents) of the Service and all content displayed on FreeShort (including but not limited to trademarks, logos, marks, applications, source codes, programming interfaces, web pages, text, images, audio, video, graphics and those obtained when you use the Service on our platform) belong to FreeShort or other right holders. Unless otherwise agreed, you agree not to use, modify, copy, distribute, change, disseminate or publish the above content without our written consent, otherwise you shall be responsible for compensating us or other right holders for all losses caused thereby.

You acknowledge that you have all rights to upload and publish relevant content on FreeShort (including but not limited to text, images, audio, video, or performances, music, sounds or dialogues contained in audio/video). If the content you upload or publish on FreeShort involves the interests or intellectual property rights of any third party, you guarantee that you have obtained the legal authorization of the relevant right holder before uploading or publishing the content. You also guarantee that you will not enter into any agreement that restricts you from fulfilling the obligations described below.

 In view of the nature of some features of FreeShort, you acknowledge and agree that other users of FreeShort may use the content you upload or publish on the platform when creating or publishing content on FreeShort. Therefore, you agree to respect the ownership and intellectual property rights of the legal owners when creating content using other users' content. You agree to comply with these Terms and the requirements of the legal owners when using such materials and works. We do not guarantee that you can use the above materials and works in all ways. For example, your use may be restricted by author's rights, privacy rights, trademark rights and/or publicity rights. We do not make any express or implied warranties about the suitability, legality, non-infringement or fitness for a particular purpose of the content (including scripts and materials, etc.) provided by us or other users.

You hereby grant us a global, perpetual, non-exclusive, irrevocable, royalty-free, sublicensable right to use, modify, copy, distribute, publish, post, link, publicly perform, test, publicly transmit, distribute, promote or otherwise use the content you upload or publish (including but not limited to text, pictures, music, performances and audio and video recordings, etc.) and use your real name, nickname, portrait, icon or any other text or graphics of similar nature in our promotional materials (including but not limited to web pages, printed materials and commercial documents, etc.). You also grant us the right to claim sole and independent damages for any infringement of intellectual property rights in content you upload or post.

The right to sue or take other legal action and obtain all compensation (if any).

If you believe that the content uploaded on the platform infringes your legal rights, please notify us in accordance with the relevant rules of the platform. If we receive a notice that the content you uploaded is suspected of infringement, in order to protect the intellectual property rights of the legal right holder, we may delete the suspected infringing content on our own and notify you as soon as possible so that you can negotiate a solution with the legal right holder. You can send us a counter-notice, but this will not affect the measures we will take/have taken.

Privacy Policy

We are committed to respecting the privacy of users and may collect, store, use, disclose and protect your personal information in accordance with our privacy policy. Detailed policies can be found in the Privacy Policy, and we encourage you to read it carefully.

General Terms

Force Majeure: We are not responsible for any damage or loss caused by force majeure. For the purpose of this Agreement, force majeure includes force majeure, changes in laws, regulations or government orders, specific reasons due to the characteristics of Internet services, such as failures attributable to domestic and/or foreign basic telecommunications operators, computer or Internet-related technical defects, Internet coverage restrictions, computer viruses, hacker attacks and other unforeseeable, unavoidable and insurmountable circumstances within the scope permitted by laws and regulations.

FreeShort is a platform that connects people and does not directly upload or provide content. The content or information posted by users does not represent our views, positions or policies. We do not make any guarantees about the accuracy, reliability, completeness, legality and validity of the content or information you are exposed to during the use of the service. You acknowledge that you may be exposed to unpleasant content when using the service. You agree to judge the content at your own discretion and we will not be responsible for any damage you suffer due to reliance on such content. You agree to negotiate and resolve any disputes and/or losses arising or may arise between you and other users or between you and other rights holders due to the use of relevant content or works, and you will not be responsible for such disputes or losses under any circumstances.

Please pay attention to the surrounding environment during the use of the service to ensure your personal safety. You agree that in no case will we be liable for any personal injury or property damage caused by you (to you or any third party) during the use of the service.

Changes, suspensions, interruptions and terminations of the Service: We reserve the right to change, suspend, interrupt or terminate the Service for the following purposes: to implement our business decisions; to execute administrative/judicial orders; to protect the security of the Service; to maintain the correct use of the Service by other users and the security of data; to respond to suspected infringements by others; or in our own judgment, we suspect that your behavior violates the Terms of Service or the rules published from time to time, or violates laws and regulations. In such cases, we reserve the right to change, suspend, interrupt or terminate the Service provided to you and immediately delete all your content without any liability to you or any third party.

Notice: All notices given to you under this Agreement may be sent by email, regular mail or by posting in a prominent position on the Website/Platform.

These Terms shall be governed by the corresponding national laws of each country, without regard to conflict of law principles. If these Terms conflict with the laws of each country, the provisions of the national laws shall prevail. In this case, the relevant content shall be modified or reinterpreted in accordance with the legal provisions, and the remaining provisions of these Terms shall remain unchanged. Any disputes arising from or related to these Terms shall be submitted to the International Economic and Trade Arbitration Commission ("IETAC") for arbitration in accordance with its rules in force at the time. The language of arbitration shall be English and the arbitration panel shall consist of three arbitrators. The arbitration decision shall be final and binding on both parties.

These Terms shall take effect from the date of publication and constitute the entire agreement between you and FreeShort.

Our failure to exercise, delay in exercising, or partial exercise of our rights under the law and these Terms shall not be deemed a waiver of such rights and shall not affect our future exercise of such rights.
